Why should victimless crimes be illegal? The most influential moral philosopher on the development of modern western law has been J.S. Mill who argued in his book On Liberty that the government can only justly limit our individual freedom to prevent us from harming others, which is why laws against murder, assault, and theft are just. Therefore, on what grounds can the state justly forbid victimless crimes? Some examples of victimless crimes in certain jurisdictions include: jaywalking, seatbelt requirements, speeding, drunk driving, gambling, drug use, prostitution, pornography, incest, sodomy, adultery, and apostasy.

Grounds for victimless crimes: 1) Certain victimless crimes don’t cause harm directly but increase the chances of indirect harm (eg. Speeding, drunk driving). 2) Some victimless crimes harm only the person committing the crime (eg. Drug use, refusing to wear seatbelt/helmet). 3) Certain crimes which don’t cause harm may cause offense (eg. Public nudity, hate speech). 4) Many victimless crimes are enacted to enforce a moral consensus (eg. Prostitution, incest, sodomy, adultery, pre-marital sex, apostasy). However, an issue with moral consensus is that the laws reflect the morals of the law-makers, not necessarily the society, and the moral systems of minorities will be criminalized.

1) Are there any just grounds to forbid victimless crimes?
2) Should the state forbid us from harming ourselves (eg. drug use, seatbelts/helmets, suicide)? If yes, why not criminalize junk food, tanning beds, and mountain climbing?
